Terms of Service
These terms govern your access to and use of the Polaris platform, including our web application, mobile interfaces, and AI-powered services.
Acceptance of Terms
By accessing or using Polaris, you agree to be bound by these Terms of Service and our Privacy Policy. Polaris is a product of DPATH PTE. LTD., a Singapore company. Polaris is a healthcare care-coordination and health-record management platform intended to help patients and their authorized caregivers organize information and collaborate with clinical and caregivers. If you do not agree to these terms, you are strictly prohibited from using the Service.
Eligibility & Local Law Compliance
By creating an account, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction). If you are a minor, a parent or legal guardian must create and supervise the account.
You may use Polaris only in jurisdictions where it is lawful to do so and in compliance with all applicable local laws and regulations, including those relating to health information privacy and data export.
Use of Services
You agree to use Polaris solely for lawful purposes and in strict accordance with these terms. Do not upload or share health information about another person unless you have their explicit authorization. You are responsible for protecting the privacy of Protected Health Information (PHI) and respecting the rights of your care team members.
The platform uses advanced technologies, including Google AI models provided by Google, to process documents and surface insights. AI-generated content is provided strictly for informational purposes, may be incomplete or inaccurate, and must be reviewed and verified by you and your healthcare professionals.
You must not misuse the Service, including by attempting to access data you are not authorized to see, interfering with the platform, or reverse engineering or scraping the software, except as permitted by law.
User Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We employ strict security measures, including explicit header-based authentication and encryption, to protect your account.
You must notify Polaris Support immediately of any unauthorized use or suspected breach of security. We reserve the right to suspend accounts that exhibit suspicious activity or violate our security policies.
Caregivers Collaboration
Polaris allows you to invite family, friends, or professionals to your 'Caregivers'. You control the specific permissions granted to each member, such as access to documents, biomarkers, or messaging.
Supported security-sensitive Caregiver actions in the Support Workspace are recorded for audit and security monitoring. Audit coverage must be validated for each workflow. You are responsible for managing who has access to your health data.
Payments & Rewards
Certain premium features or services may be billed via our payment processor, Stripe. Fees, taxes, and billing terms will be disclosed at purchase. All fees are non-refundable unless otherwise required by law.
Polaris may offer reward programs that distribute incentives, such as Amazon gift cards, for engagement. These rewards are processed via external provider APIs and are subject to the terms and conditions of the respective issuers.
Data Ownership & License
You retain full ownership of the medical documents and personal health information you upload to Polaris. By uploading content, you grant us a limited, non-exclusive, worldwide license to host, process, encrypt, and display this information solely for the purpose of providing the Polaris services to you and your designated care team.
Service Availability & Changes
Our platform is built on a distributed edge architecture (Cloudflare Workers) designed for high availability. However, we do not guarantee uninterrupted or error-free operation, and service may be temporarily interrupted for maintenance, updates, or due to factors beyond our control.
We may modify, suspend, or discontinue parts of the Service, or update these Terms, from time to time. If a change materially affects your rights, we will provide reasonable notice as required by law.
Termination
We may suspend or terminate your access to Polaris at any time for violation of these terms, misuse of the platform, or legal requirements. You may terminate your account at any time via your account settings.
Upon termination, your access will cease. We will retain and delete data in accordance with our Privacy Policy and applicable law.
Disclaimer & Limitation of Liability
Polaris is provided “as is” and “as available.” To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Polaris and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or revenues. Our total liability for any claim related to the Service will not exceed the amounts you have paid us in the 12 months preceding the event giving rise to the claim, unless applicable law requires greater liability.
Governing Law & Jurisdiction
These Terms of Service and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict-of-law provisions.
You agree that the courts of the Republic of Singapore shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
